This website was established to inform you of the proposed settlement of a class action lawsuit in Washington State. regarding the payment of “loss of use” benefits for claims for property damage under the uninsured/underinsured motorists coverage (“UIM PD”) of USAA’s Washington auto insurance policies.

The proposed Settlement includes all Washington State auto insureds of the USAA companies who submitted UIM PD claims from September 30, 2008 through April 11, 2023, who were without the use of their car for one day or more while their car was being repaired or totaled, and who were not offered payment for a rental car or for loss of use Insureds who had “Rental Reimbursement Coverage” for their applicable accidents are not part of the Settlement. The USAA companies deny that they did anything wrong, and maintain that they have complied with and exceeded their obligations under their insurance policies and Washington law. The Parties, however, have agreed to settle the lawsuit to avoid the cost, delay, and uncertainty of continued litigation.  

The Court will hold a Fairness Hearing (also called a “Final Approval Hearing”) on March 29, 2024, at 1:30 p.m. Pacific time to decide whether to approve the Settlement.
